In the following Terms and Conditions, "The Management"
refers to jasminmusic,
it's owner(s), associates, partners or employees; "The
Customer" or "Customers"
refers to visitors to the jasminmusic website
and individuals, groups, institutions
or companies making purchases of sheet music or other
products advertised or
otherwise made available through this website.
- Copyright. The copyright to all the titles
listed on this website is owned by John Rayson (or other authors
where specified), and any unauthorised copying (physical or or
electronic reproduction of the sheet music by any means) is illegal.
Unauthorised copying will inhibit the publication
of specialist sheet music such as is available via the jasminmusic
website, and is ultimately, therefore, disadvantageous to all
musicians.
- Live performance. Customers purchasing titles
from the jasminmusic website catalogue agree to inform the British
Performing Right Society (PRS), 29-33 Berners Street, London W1T
3AB, in the event of any public performance of any such title
in a PRS listed venue. If in doubt about the PRS status of any
venue, please contact the society at the address given.
- Recordings. Customers purchasing titles from
the jasminmusic website catalogue who subsequently include a performance
of any of these titles on a commercial recording (CD, Tape, Video,
DVD) agrees to inform the Mechanical Copyright Protection Society
(MCPS), 29-33 Berners Street, London, W1P 4AA, of this fact. Similarly,
in the event of any use of titles from the jasminmusic catalogue
for Radio, Television or Cinema, then the MCPS must also be informed.
- Order fulfilment. Orders will only be despatched
on receipt of full payment, including postage and packing charges.
The Management are unable to supply copies of titles from the
jasminmusic catalogue on an approval basis. If The Customer is
unsure about the suitability of any title, they should contact
The Management (by phone, fax or email) before making any order.
In the event of a Customer subsequently being dissatisfied with
any title from the jasminmusic catalogue, a refund may be given
at the discretion of the Management, provided any such request
is made within 14 days of receipt of the original order.
- Charges. The Managment reserves the right to
alter prices and postage and packing charges at any time and without
notice. To make sure you are seeing the most up-to-date version
of the website catalogue, always press the "refresh"
button on your browser from time to time. The Management also
reserve the right to delete titles from the catalogue at any time
and without notice.
- Product updates. The Management reserve the
right to update or alter titles in the catalogue at any time and
without notice. Such updates or alterations may take any or all
of the following forms; changes of melody, harmony, counterpoint,
musical texture, instrumentation, string writing or other effects,
page layout, pagination, repeats, staff size, line thicknesses,
font, font size or style.
- Mechanical liability. The Management will take
all reasonable steps to ensure the continuity and reliable operation
of the website (www.jasminmusic.com), but accepts no responsibility
for any failure of any Customer's computer equipment, software,
modem or other peripherals, nor for any failure in electronic
transmission between The Customer's computer and any third party
payment processor.
- Privacy. Under no circumstances will The Management
make available to any third parties Customer's details (address,
telephone numbers, order history). The Management have no access
at any time to Customer's credit/debit/payment card details.
- "MIDI" and "PDF" service.
Where a "MIDI" or"PDF" service is advertised,
order fulfilment will only take place where the charge for both
the title(s) ordered and the additional "MIDI" or "PDF"
charge have been received in full. This service is only available
to UK based customers unless prior agreement has been reached
with the Management. The Management accepts no liability for any
failure of customers' computer, modem, printer or other equipment
which may lead to a failure to receive any title ordered through
this service. The Management reserve the right to decline without
reason any order using the "MIDI" or "PDF"
service.
- Discounts/special offers. The Management reserve
the right to offer discount or special promotional offers from
time to time, offers which may include groups of pre-selected
titles offered as "Collectors' Editions", "Performers'
Editions", or other appropriate descriptions.
